The OurX Site and the various content, products, and services offered on and in connection with the Site is owned and operated by OurX, Inc. (“OurX”, “we” or “us”). OurX values its customers and respects their privacy. Any information we collect about you is held with the utmost care and security. Your visit to the Site and your use of any of the Services or features we provide is subject to our Terms of Use of which this Privacy Policy is part. This Privacy Policy (together with our Terms of Use and any other documents referred to in it) sets out the basis on which any personal information we collect from you, or that you provide to us, will be used, shared or processed by us. This includes personal information we collect online when you visit the Site. When we use the term "personal information" we are referring to information that is connected to your name. This may include things like your e-mail address, mailing address, birthday, or telephone number, when those pieces of data are stored with your name. When you register with us, you can view your personal information in 'My Account'. You can access 'My Account' directly to change any personal details, for example if you want to change your address. If you forget your password, simply click on the 'forgotten password' link on the register or login page and an e-mail containing your decrypted password will be sent to the e-mail address you originally provided. Please note that when making a Product or Subscription purchase on our Site, you are automatically creating an account with OurX.
1.2 Information we collect about you. With regard to each of your visits to our Site, we use some of the following various technologies to automatically collect information about you:

If you are under the age of 13 you can look at our Site, but you may not make a purchase, register, or submit any personal information to us. If we become aware that we have inadvertently received personal information from a visitor under the age of 13 on the Site, we will delete the information from our records.
What we do with the Information

2.1 Information you give to us. We will use this information in relation to:
(a) Administration of our Site: The information you give us is necessary to enable us to (i) recommend a personalized hair care regimen comprised of a selection of our Products; (ii) fulfill your order (including acknowledging your order and communicating with you if there is any issue regarding the fulfillment of your order); (iii) make sure your order is delivered correctly; and (iv) maintain your account.
(b) Customer service: We ask for your contact details, such as your e-mail address and telephone number, to enable us to answer any questions you have about using our Site and to notify you about the status of your orders.
(c) Direct Marketing: We want to keep you up to date on our latest Products, promotional offers and events.

(c) Customer service: The information we collect from you will allow us to (i) allow you to participate in interactive features of our service when you choose to do so, such as chat and hair coach consultations; (ii) measure or understand the effectiveness of advertising we serve to you and others and deliver relevant advertising to you; and (iii) make suggestions and recommendations to you and other users of our Site about goods or services that may interest you or them. As an example, we may use information collected about you from the online hair survey you may complete, called “The Hair Assessment,” in order to provide context in connection with hair expert consultation services you may elect to receive.
(d) Security of our Site: As part of our efforts to keep our Site safe and secure.
2.3 Information we receive from other sources. We may combine this information with information you give to us and information we collect about you. We may use this information and the combined information for the purposes set out above (depending on the types of information we receive).
Disclosure of your information
3.1 We may share your personal information with affiliates of OurX that are controlled by us. They may use the information in accordance with their privacy policy for purposes such as: financial reporting and analysis; strategic planning; development of customer segmentation and metrics to provide a consistent view of our customer base; the creation of inspiring content and editorial features, and the development and sale of new products and collaborations to enhance your experience as a customer of OurX.
3.2 From time to time we retain the services of third party companies and individuals to perform functions on our behalf in connection with the successful operation and continuous improvement of this Site. We may share your information with selected third parties including:
(a) Business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you (e.g. in order to process your order and maintain your account, including the authorization and validation of credit or debit card transactions, the provision of delivery services, the analysis of data, the provision of subscription management services, third party payment services, etc.). These companies or individuals may be provided with access to your personal details in order to fulfil their function but may not use such information for any other purpose.
(b) Advertisers and advertising networks that require the data to select and serve relevant advertisements to you and others.

How we protect your personal data
4.1 We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and applicable law.
4.2 For certain features available through the Services, we may now, or in the future, use encryption technologies to protect transactional information you provide to us, and/or may require your use of a UserID and password after setting up an account. Transactional information includes any credit or debit card details, your personal contact information together with any other names and addresses you provide when you place an order for delivery to another address, and your purchasing history. If you have given your consent prior to entering the details required for the ordering process, our Site will retain your account details such as your name, address, e-mail address and purchasing history. In addition, we use Shopify which has a feature whereby you can elect to save your credit card information and re-utilize it by confirmation, using a secure code. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

You, however, are ultimately responsible for protecting your UserID, password and account information from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies. You agree to (a) immediately notify OurX of any unauthorized use of your UserID, password and/or account, and/or any other breach of security, and (b) ensure that you exit from your account at the end of each session. While we may provide certain encryption technologies and use other reasonable precautions to protect your confidential information and provide suitable security, we do not and cannot guarantee or warrant that information transmitted through the internet is secure, or that such transmissions are free from delay, interruption, interception or error.
4.4 We will only retain personal information for as long as is reasonably necessary for us to render the Service you have requested or to which you have given your consent, and for business and/or legal reasons.
Anonymous Data
When we use the term “anonymous data”, we are referring to data and information that does not permit you to be identified or identifiable, either alone or when combined with any other information available to a third party. We may create anonymous data from the personal data we collect. Anonymous data might include analytics information and information collected by us using cookies. We make personal data into anonymous data by excluding information (such as your name) that makes the data personally identifiable to you. If we modify this Privacy Policy, we will either post a notification of the modification on our Site or otherwise provide you with notice of the change. The date of the last modification will also be posted at the beginning of this Privacy Policy. It is your responsibility to check from time to time for updates. Modification or Deletion of Information
